The Mediation Process
Pre-mediation
The mediator contacts each party separately to obtain background information and create an agenda for the mediation session. This initial contact can be done in a face to face meeting or over the telephone. The mediator provides a copy of the Mediation Agreement to each party to review.
The mediator also explains the mediation process, the role of the mediator and the parties, confirms the names of the parties and other participants as well as their contact information.
Mediation Session
The mediation session generally observes the following:
1. Introduction to the mediation: review of the purpose of the mediation, the role of the parties, ground rules, signing the Mediation Agreement
2. Each party will present its initial perspective and position
3. The mediator will discuss the issues, needs, interest and will propose to the parties the problems to be resolved.
4. Options will be generated with the assistance of the mediator.
5. Solutions to the problems are presented and discussed.
6. Options are evaluated and refined that will form the basis of the understandings and the agreement.
7. The terms of the agreement are finalized by the parties.
